BANKRUPTCY

PRACTICE AREAS

Under federal law, we are designated as a debt relief agency. We help people file for bankruptcy under the Bankruptcy Code.

EXPERIENCED ATTORNEYS EXPERT ADVICE

If you are struggling financially with credit card debt or other bills that seem overwhelming, or if the current economy has resulted in a sudden job loss, it might be time to consider bankruptcy.

It may be that you can get a “fresh start” by filing a Chapter 7 or Chapter 13 bankruptcy.  You need to talk with an experienced bankruptcy lawyer who can provide you with solid legal advice.

For more than two decades, the attorneys at Pratt & Wall, Attorneys at Law, have provided honest and candid counsel to clients who have questions about bankruptcy in Georgia.  Our attorneys have accounting and tax backgrounds and are very experienced in helping you decide if bankruptcy is the right choice for you.  We will work hard to help you find the quickest and most cost-effective solution to move forward.

We will take the time to understand your financial situation. Then we will explain your options with Chapter 7 and Chapter 13 bankruptcy, including the filing requirements, the time involved, and when you can expect some relief.

SELECTING THE RIGHT BANKRUPTCY CHAPTER FOR YOU

If you have decided to seek relief from your debts through bankruptcy you need to decide which type of case to file.

We have handled numerous individual and family bankruptcy cases and we will review your financial situation to advise you on which chapter is the best choice for you. We can also assist with bankruptcy alternatives, such as challenging credit card lawsuits in court.

IS CHAPTER 7 BANKRUPTCY RIGHT FOR YOU?

If you do not own a significant amount of property but you owe a lot of unsecured debt (including credit card debts or medical bills), and just need a fresh financial start, Chapter 7 may be the right type of bankruptcy for you. Chapter 7 may also be appropriate if your finances have been devastated by medical bills, job loss or divorce.

In order to file Chapter 7 your household income should be below the median for a family of your size in Georgia. If your income is higher than the median, then our attorney will put your budget through what is known as a "means test" to see if you are eligible for Chapter 7.

IS CHAPTER 13 BANKRUPTCY RIGHT FOR YOU?

Chapter 13 bankruptcy is a court-supervised debt repayment plan. If you have a significant amount of nonexempt property that you want to keep, or if your car is being repossessed or your house is in foreclosure, or if you have too much equity in either of them to file a Chapter 7 bankruptcy, then this form of bankruptcy may be best for you.

Once your case plan is approved, you will pay back a portion of your debts to your creditors over the span of three to five years.
